EMPLOYEE DISCRIMINATION CLAIMS RISING

According to statistics kept by the U.S. Equal Employment Opportunity Commission, total discrimination claims filed by employees against employers are on the rise.   These claims include those alleging race, sex, national origin, age and disability discrimination, as well as claims of retaliation and pregnancy discrimination.

Employers here in Humboldt County, California are not immune.   Defending discrimination claims takes time and money that could be better spent elsewhere.  The most important thing employers can do to prevent discrimination claims is to have a legitimate, nondiscriminatory reasons for all employment decisions, and then document everything appropriately.   Clear management policies and documentation are often the keys to successfully defending or settling discrimination lawsuits.  From the outset of employment, make performance expectations clear.    If you have written job descriptions, make sure they are kept current.  If you have performance evaluation policies, they must be followed, and all employment decisions based on such evaluations should be documented.    All employees in the chain of command should be clear about job-related expectations, as well as policies of non-discrimination.

Risk Management Seminar – Healthcare Pros

Among the many important functions of the Humboldt-Del Norte County Medical Society is ongoing educational programs for health care professionals of Humboldt and Del Norte counties.  The next in the series of Risk Management Seminars will take place on October 1, 2009, and the subject matter will be “Anatomy of a Lawsuit.”  Presenters will include Risk Management and Claims professionals from Norcal Mutual Insurance Company and attorney Michael Morrison of the Janssen Law Firm in Eureka, CA.

As lessons will be drawn from actual, closed medical malpractice cases, health care professionals will have the opportunity to learn the “easy way” from the “hard lessons” of others.   Mr. Morrison’s extensive experience in representing physicians and allied health professionals in Humboldt County, Del Norte County and adjoining counties will assure local and practical advice during the presentation.  Mr. Morrison will also be available to answer questions from the attendees.

Recent CEQA Decisions and Guidelines

The California Environmental Quality Act (CEQA)(Pub. Res. Code Section 21000-21177) applies to most public agency decisions to carry out, authorize, or approve projects that may have adverse effects on the environment. CEQA requires that all agencies participate in the mandated CEQA review process in order to inform themselves and the public of the environmental effects of proposed projects, to consider all relevant information in the decision-making process, and to reduce potential harm to the environment when feasible. CEQA court decisions and the CEQA Guidelines (contained at Cal. Code Regs. Section 15000-15387) offer a continually expanding resource for CEQA practitioners.
