Frequent Flyer Miles Tax Issues

Citibank has sent a number of customers 1099 tax forms to report their frequent flyer miles earned when they opened a checking or savings account last year.  (Citibank Article.)  The terms and conditions of the offer were disclosed in promotional materials, but the practice has caused confusion and concern for many who must now report their frequent flyer miles (and possibly other credit card rewards for that matter) as income.

Wrongful Death – A Measure of Damages

When a  loved one has died due to the negligent or careless conduct of another, the lawsuit that may follow is termed a wrongful death action.  This posting will focus on the concept of reasonable compensation for the non-economic aspects of the loss of a loved one.

In a wrongful death action, the applicable jury instruction states provides that reasonable compensation should be awarded for the loss of love, companionship, comfort, affection, society, solace, or moral support.  This is non-economic damage.

$8 Million Verdict Against Nursing Home

A Jefferson Circuit Court jury on Monday awarded $8 million in damages to the estate of a retired surgeon whose legs were broken while he was in the care of Treyton Oak Towers in Louisville.

The verdict against the nonprofit nursing home was returned after a two-week trial before Judge Brian C. Edwards.

Wage Theft Protection Act of 2011

Under what is commonly called the Wage Theft Protection Act of 2011, beginning January 1, 2012, California employers must provide all non-exempt new hires with certain written information at the time of hire, including: (1) rate(s) of pay, (2) meal or lodging allowances claimed as part of the minimum wage, (3) the regular payday(s), (4) the name(s) of the employer, including any “doing business as” names, (5) the employer’s physical address or principal place of business, and a mailing address if different, (6) the employer’s telephone number(s), (7) the name, address and telephone number of the employer’s workers’ compensation insurance carrier, and finally (8) “Any other information the Labor Commissioner deems material and necessary.”

Arcata Community Pool

The Arcata Community Pool, located next to Arcata High School in Humboldt County, is operated by the Arcata Parks and Recreation District.  The Pool offers numerous instructional and exercise options, including swim lessons, kayak instruction, lap swimming, water exercise programs, youth parties (with the option of the water slide), and lifeguard certification.  The facilities include a hot tub, sauna, and exercise room.
The District Board, which includes Janssen Malloy LLP partner Michael Morrison, meets monthly and invites public input at its meeting.
