As we enter the holiday season, Janssen Malloy LLP encourages all to take a moment to reflect on your good fortune, and to give some attention to those less fortunate. In Humboldt County many worthy groups work to help the hungry and homeless, but we ask consideration of two of those that we support — Food for People and Betty Chin’s Blue Angels.

Food for People is Humboldt County’s Food Bank. Again this year Janssen Malloy is a sponsor of the Holiday Food and Fund Drive, a way to assist this worthy organization to help feed those in need of food. Proceeds from this drive are an important part of raising the funds necessary to support all of this organization’s programs.

Betty’s Blue Angels started out as one woman — Betty Chin– who took it upon herself to feed and care for those in need. Her endeavors are now supported by volunteers and the community, including the recent building of a shower and laundry facility in Eureka for homeless people.

If you are interested in donating to these worthy organizations, you can not only find more information on these two charities at the links provided above, but you can also donate directly from the web sites.

Since 1956, Legal Services of Northern California (“LSNC”) has provided quality legal services with a mission to empower the poor to identify and defeat the causes and effects of poverty in their community. Twenty-three of Northern California’s counties, including Humboldt, Del Norte, and Mendocino make up the LSNC service area, where the low income population exceeds 500,000. LSNC provides free civil legal services to low-income individuals, families, and community-based organizations.

Funding to LSNC from its primary sources is being reduced; funding from the Legal Services Corporation will drop $160,000 for this year, and Income on Lawyers Trust Accounts (“IOLTA”) funding continues at historically low levels due to low interest rates.

LSNC and the members of its Board of Directors are seeking donations from all who appreciate the importance to all of society that legal representation for the disadvantaged provides. Please consider a contribution to help LSNC weather this financial storm. For more information go to (website address)

LSNC, which is headquartered in Sacramento, has offices in Eureka, Humboldt County and Ukiah, Mendocino County. Janssen Malloy LLP partner Michael Morrison serves as a member of the Board of Directors. Janssen Malloy LLP has long supported the efforts of LSNC through both financial contribution and by its lawyers donating their time to staff the Eureka office’s pro bono civil clinic.

That automobile accidents are a fact of modern life is undisputed, yet most of us assume such things happen to others. When a paralegal and lawyer from the Janssen Law Firm, while out serving papers in Eureka, California, were struck by a car darting out of an alley it was a bit of a struggle to remember just what to do.

The obvious was easy– anybody hurt? When the answer to that is “no” the police do not have time to investigate and you must be sure to get the pertinent information. Following is a list of the type of information you should obtain.

1. Always get identifying and contact information from the other driver (name, phone number, address).

2. Be sure to get all insurance information (insurance company name and contact telephone number, policy number, etc.).

3. Listen for admissions of fault, but do not make any in the excitement of the moment.

4. Remember that your cell phone probably has a camera– use it! Document all damages to the vehicles as well as license plate numbers.

Call your own insurance company as soon as practical, and do not forget that DMV must be notified of all but the most minor of collisions.

If you have been in an automobile accident and need additional assistance, please contact us. The Janssen Law Firm has successfully represented hundreds of people who have been injured in truck and auto accidents.

The first 2010 meeting of The North Umpqua Foundation (“TNUF”) Board of Directors was held at the Steamboat Inn on March 21st.

The meeting was highlighted by the presentation by Michael Love of Michael Love and Associates of Eureka, California of its Design Recommendations for improving fish passage at Steamboat Falls. Steamboat Creek is one of the most important spawning streams for the North Umpqua River.

The study, which was commissioned by TNUF, features three separate but potentially cumulative means of improving the effectiveness of the current fish ladder. Built in 19589, the ladder is prone to blockage and sediment buildup, which interferes with the ability of steelhead and chinook salmon to access upstream spawning locations. The study also proposes for consideration another approach, that of near- natural rock pool fish passage system in the rock channel at the site.

Attending the meeting were many representatives of the Umpqua National Forest (“NFS”) and the Oregon Department of Fish and Wildlife (“ODFW”.) These agencies assured the Board that the study would be considered carefully in the new effort to improve fish passage on Steamboat Creek.

Anyone interested in a copy of the study may contact Michael Morrison, spike@janssenlaw.com.

THE RECORDER recognizes the Janssen Law Firm’s successful defense of Pacific Gas & Electric Company in Humboldt Country personal injury lawsuit arising out of injury in Ferndale.

On September 29, 2009, THE RECORDER highlighted the Janssen Firm’s recent success in defending Pacific Gas & Electric Company against a personal injury lawsuit involving an electrical contact injury with the following article:

PRODUCTS LIABILITY:
A jury found against a handyman who sustained severe, third-degree burns in a workplace accident.
On Aug. 3, 2004, Joseph Royse, then 22, was cleaning gutters with the assistance of a boom lift at a Ferndale ranch. He came into contact with a 12,000-volt power line. Royse, who was in a temporary coma and had undergone 18 procedures by trial, claimed that PG&E negligently placed power lines near his worksite. He also sued lift maker JLG Industries for defective design and inadequate warnings and lift lessor Darr-B for negligent instruction. JLG denied a design defect regarding the subject boom. PG&E contended that the power line’s placement was in compliance with all proper standards and was safe.

Case: Royse v. Pacific Gas and Electric Co., DR050078
Court: Superior Court of Humboldt County, Eureka

Counsel for the plaintiff: William Bragg and Randy Perlman, Bragg, Perlman, Russ, Stunich & Eads, Eureka; Gerald McGee, Law Office of Gerald McGee, Eureka
Counsel for the defendant: Michael Morrison and Patrik Griego, Janssen, Malloy, Needham, Morrison, Reinholtsen, Crowley & Griego, Eureka; James Pincin, Nisson, Pincin & Hill, Redding; Frank Schimaneck, Dryden, Margoles, Schimaneck & Wertz, ALC, San Francisco.
